By all means, talk to a "reputable" bankruptcy lawyer in your area. Most give free consultations and will answer your questions with regards to credit etc.While I, personally, do not encourage filing bankruptcy, I can tell you that I have 2 close friends who went through the same thing that you are currently going through. Each one told me that they felt like low-lifes, worked hard all their life and had good credit up until their divorces.
Their divorce settlements were all trade-offs and Quick. However, both my friends were stuck absorbing a large amount of the credit card debit (occured by both parties in the marriage). My one girlfriend's, now ex-husband continued to run all the credit cards up during the beginning of divorce proceedings. She had to call each one of them and tell them to stop and that she will no longer be responsible for the debit that occurs after such and such date. However, she had to occur all those charges for an additional month (before she caught the billing statement) all why he was under court order as to everything be under a "freeze"! Did the courts do anything? Nope!
The best thing I can tell you is that both my friends have been relieved by filing bankruptcy and can see the light at the end of the tunnel. They no longer feel that they are robbing Peter to pay Paul. They have the extra money now to put away for a rainy day or to buy the extras that come along with raising a child. Yeah, their credit has been tarnished however, in some cases, what really is a person to do?
