It has been 3 1/2 years since my ex & I have split. During that time, my daughter, who is now 5 was attending daycare full time, at a cost of $165 per week. This figure was figured into the child support payments. She is now in Kindergarted, 1/2 days and goes to a morning school club at the school, during the time her mother would have her, and I pick her up at 3pm, when she is done her afternoon K session. 3pm is my pickup time on the custody agreement.

1st question. Am I still responsible for paying for the AM daycare program at school since it falls during her mothers parenting time? She will be done that after this year.

2nd question. I would like to have the support recalculated, as I feel that my ex now has a HUGE excess of money from support that is no longer warranted just from the lack of full time daycare. Should I try for it or am I going to get laughed out of court?

I think most states allow for regular recalculation (maybe every two years or after some major event like a layoff). Go through the Child Support Enforcement Agency who will then send forms to each parent. The figure is mostly dependent on the incomes of each parent, so while the child care cost may have some factor there are other expenses such as school fees that generally are always coming up. So in general the child support calculators take both parents' incomes and define a certain standard of living that each need to support based on thier income relative to the other.
