MY WIFE AND I ARE GOING THROUGH A DIVORCE,,,MY WIFE HAS MY DAUGHTER FOR NOW.

I DRAW A DISABILITY CHECK,,,MY DAUGHTER ALSO DRAWS A CHECK,,HERS IS 600.00 PER MONTH,,IT IS BECAUSE I AM DISABLED,,MY CHECK IS 1200.00 PER MONTH.

MY WIFE WANTS HER WHOLE DISABILITY CHECK AS CHILD SUPPORT,,EVEN THOUGH I HAVE HER EVERY OTHER WEEKEND,,,DO I JUST DO THIS,,,OR DO I NEED TO SEE AN ATTORNEY?

I HAVE BEEN GIVING HER 325.00 PER MONTH.

WE GO TO COURT FOR FIRST HEARING ON DECEMBER 20TH

I would talk to an attorney. I am under the impression that SSI ( am assuming you are tlaking about SSI with disablity) as a rule goes in full to the parent the child lives with primarily.

I'm sorry I dont quite undewrstand your situation. Are you disabled, or is your daughter disabled, or both??

My daughter gets SSI as she is disabled, no where near that much but stil a little extra every month. The check goes to the parent that the child lives with full time. AS they are they one actually paying rent for the child, power, food, day care, all the extra little things, school clothes etc. I am not understanding why if your daughter doesnt live with you you would feel it is your right ro her check?

I'm wondering why you're keeping that check, too. If she gets $600 and you pay $325 in child support, what are you doing with the other $275? Ar you putting that into a saving account for your daughter or buying her clothes, recreation, etc? It is so expensive to raise children; $325 a month is basically grocery money.

Do the people who issue her disability check think she lives with YOU? How else does that check come to you? I'm sorry to pin you to the wall, but that money is not helping your daughter, it's helping you.
