I am sick of being taken advantage by my ex and have no money to go back to court for support modification and change of decree. Basically he moved 3000 miles away and I still get the $300 a month for two children. In the decree is says I claim 1 child and he claims the other on income taxes. But this year I want to claim both. Does anyone know what will happen to me if the refund actually goes through and I claim 2 instead of 1?

not for sure but- if you both claim a child I am sure a big red flag will go up to the IRS- is it worth it? Trying changing things legally first before you get in trouble.

I know someone's Ex who did this. Yep, the IRS caught it the first year. Especially if you use turbo tax or e-file. Had to produce (fax) divorce decree, both were audited and the one who filed falsely had to pay back plus interest. However, the one who did it correctly, refund was held up because of this until all was straightened out.

I don't know what state you are in. In Arizona, child support is adjusted for parenting time. I am assuming parenting time is zer0 since the ex moved 3000 miles away. If your state adjusts cs on parenting time, I suggest that you file for cs modification. You will still probably split the children as dependents on your income tax. However, if he split town before June 30th 2006 (for 2007 income taxes); he CANNOT take both children for the earned income credit. See your tax advisor.
