So I know it's not tax season and I don't have to worry about this for a while but does anyone know if a ncp who never see their child can claim them on taxes because they pay child support?? |

I'm not a tax expert, but it's my understanding that only the designated custodial parent can claim the child on a tax return. However, if your parenting plan allows for the NCP to claim the child as a deduction, then yes, they could - but that would have to be part of the court document. There's some good info here: http://www.irs.gov/faqs/faq-kw30.html Also check out the info to file as head of household, instead of single - can save you a BUNDLE. |

The only way that the non custodial parent can claim a child if they pay more than fifty percent of your salary in child support. |

Who can take a child/children as dependents should be stated in the child support order. If you can claim head of household, the ex cannot take a child for the earned income credit for any year which your child/ren did lived with you for more than 50% of that tax year. See your tax advisor. |
