I am currently going thru a divorce and we have two children. I was awarded temporary custody and child support from the courts. My soon to be ex-husband is fighting for shared parenting rights in order to keep me from moving out of state to be close to my family. He also feels if he gets shared parenting he shouldn't have to pay child support. He moved out of our house in April '05 and the children have been with me since. I have been very cooperative and let him spend time with the kids as often as possible. He recently moved again about 15-20 miles from his old house and did not file a notice to move with the courts or was I informed until the day he picked the kids up for visitation. He moved next door to his girlfriend which my children are have a difficult time dealing with and have voiced their feelings to their father and he tells them they will have to get over it. I want what is best for them but I can't stand to see them in such hurtful situations. Can he stop me from moving out of state closer to my family. The children are perfectly fine with the move which is about 3-4 hours from their father. He would still be able to have his every other weekend visitation. I have talked to my attorney and he keeps saying it shouldn't be a problem be able to move but I'm not so sure from the information I have been reading on the internet. I currently live in Ohio and want to move to Kentucky.

Just a little word of advice, if you do move 3 to 4 hours away don’t continue with the every other weekend. You will soon find you have no life; I spent the last 6 years having to drive 2 hours one way to our meeting point every other weekend, and then having to be in limbo until he returned them to the meeting point. It soon took its toll on me and the kids. Work it out so that he has them once a month and gets more time with them during the summer to compensate.
