My son was born with a minor disability. We live in KY. My sons father left me when I was 12 weeks pregnant.. During my pregnancy I talked to him about 5 times.. He never offered to take me to my Ob/Gyn or the high risk doctor I had to see 100 miles away. I thought about not calling him once I had my son, but I did. He came to the hospital, stayed with me there {we weren't together or anything} and then he acknowledged that he was the father. Although he didn't sign the birth certificate. We were never married. The day I came home from the hospital with my son he came to my house and stayed 5 minutes. I haven't seen him since then and my son is 9 weeks old. I have been receiving KTAP {KY transitional assistance payment} and he'll have to pay it back kind of like a child support thing. Now that its coming down to it he wants a paternity test which I am perfectly okay with.. My bigger question is after paternity is established will they automatically give him visitation.. or since my child has a disability can they wait until it is "repaired." Should I get a lawyer? Since I am the only one on the birth certificate do I already have sole custody? Any advice or links you can give me will be greatly appreciated. I am just so scared 'cause my son is my everything and with his disability I am scared he won't be properly taken care of. I want him to see his father, when the time is right. Maybe the courts will just give him supervised visitation?

I'm kinda new to this website.( Which is awesome by the way) and I just read your post from Dec. Hopefully you have already gotten your answer by now but in case you haven't. Here goes -Paternity/Ch. Support is not CUSTODY- that is SEPERATE. I went through this. For paternity/Support You contact the D.A. (FREE)They Establish paternity and go through both of yours working pay and time the child lives with you -vs-him and do a little algebra and VOILA how much the nice man needs to give you each month. If he wants visitation he needs to HIRE a lawyer and sue for vistation / Custody and that costs $ and most of the time they won't follow through unless they have bonded with the child.(at least in Californa)
