I had a 1 night stand 10 yrs ago. I found the dad & let him know, but he broke off contact when I was 8 mths preg. My son is asking ques about him again, so I did a search on him & found his phone #. Should I call to see if he wants to meet his son now? I want to make sure that there is no risk of him trying to get custody. I have the phone records from 10yrs ago to show that I was in touch with him then. My mother him called after my son was was born and the message on the answering machine was that phone calls were being screened. I think that at this point it would be considered abandonment, so it should be safe legally.

with no contact in ten years it is safe that he will never get primary custody. But here is nothing that would prevent him from trying to get court ordered visitation. But I would think that after all this time he wouldn't just jump in a nd take you to court, but over time if he starts to create a bond and then feels he wants more time than you are allowing then he may try to get a formal visitation. But is all in his court and he'd have to do a lot of work. So, in too many words, I'm saying to not worry about the legal issues just yet. I
I do think it is a good idea to call him and see where he is at in his life and then based on queues you get you may mention that his son is asking about his dad. I would hope that he would respond positively, but it is impossible to predict, so go slow and cautiously, trust in God to lead you, and all will work out for the best.
